TERMS & CONDITIONS + LIABILITY WAIVER
In-Person Group Breathwork Sessions with Emily Blackwell

By registering for and participating in this breathwork session, you confirm that you are at least 18 years of age or have provided written parental/legal guardian consent, and you agree to the following terms:

1. Voluntary Participation

I understand that my participation in this breathwork session is entirely voluntary. I affirm that I am choosing to participate of my own free will. While the facilitator Emily Blackwell will exercise reasonable care and provide appropriate guidance during the session, I acknowledge my responsibility to monitor my own comfort levels and immediately communicate any concerns. The facilitator will maintain professional standards of care and implement appropriate safety protocols.

I understand that breathwork may involve: (a) intense breathing exercises; (b) altered states of consciousness; (c) emotional experiences; (d) physical responses such as light-headedness; and (e) varying individual responses based on personal health conditions.

I ACKNOWLEDGE these inherent aspects of breathwork practice while maintaining my right to standard duty of care from the facilitator.

2. Age Requirement and Health Disclosure

I confirm that I am at least 18 years of age, or if I am under 18, my parent or legal guardian has provided written consent for my participation and has reviewed and agreed to these terms on my behalf. I confirm that I have consulted with my healthcare provider as needed and have no known medical or psychological conditions that would prevent me from safely participating in breathwork. I acknowledge that it is my sole responsibility to obtain medical clearance before participating, and I represent and warrant that I have disclosed all relevant medical conditions to Emily Blackwell prior to the session. I understand that breathwork can involve strong physical and emotional experiences, and may not be appropriate for individuals with certain conditions, including but not limited to:

- Cardiovascular issues
- Respiratory conditions
- High blood pressure
- Epilepsy
- Severe psychiatric symptoms
- Recent surgeries or injuries
- Pregnancy

If I have any concerns about my health, I have consulted with a licensed medical provider before participating.

3. Personal Responsibility

I acknowledge that I am solely responsible for listening to my body and taking breaks or stopping participation at any time if I feel overwhelmed or unwell. I understand that Emily Blackwell cannot and does not monitor each participant's physical or emotional state continuously during the session, and I assume all risks associated with my participation or decision to continue participation despite any discomfort. I will not hold Emily Blackwell liable for any injury, loss, or damages that may occur as a result of my participation.

4. Release of Liability

I hereby release, waive, and discharge Emily Blackwell, her employees, agents, representatives, and any facility hosting the session from any and all liability, claims, demands, or causes of action, known or unknown, that may arise from my participation in this breathwork experience. I expressly waive all rights under California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

5. No Guarantees

I understand that breathwork is not a substitute for medical or psychological treatment. While it may support personal growth and healing, no specific outcomes are guaranteed.

6. Confidentiality + Respect

I agree to respect the confidentiality and privacy of other participants. I will not share, disclose, record, or distribute any personal information, stories, or experiences shared during the session. I understand that violation of this confidentiality agreement may result in legal action, and I agree to indemnify and hold harmless Emily Blackwell for any damages, including attorney's fees and costs, resulting from my breach of confidentiality.

7. Media Release

I give permission for any photographs or video taken during the session to be used for promotional purposes by Emily Blackwell. I understand that I must notify Emily Blackwell in writing before the session if I do not wish to be photographed or filmed. I may revoke this permission for future use at any time by written notice to Emily Blackwell.

8. No Refunds or Rescheduling Policy

All sales are final. Due to the limited space available and preparation required, no refunds, credits, or transfers will be issued for missed sessions or cancellations. A documented medical emergency, verified by a licensed physician, may entitle participant to reschedule once within 90 days of the original session date, subject to availability and at Emily Blackwell's sole discretion.

I understand that by registering, I am reserving a spot in a time-limited, in-person group experience, and my payment secures my participation. If I am unable to attend for any reason, I accept full responsibility for that choice and understand that no refund or make-up session will be offered.

9. Severability

If any provision of this agreement is held to be invalid, void, or unenforceable by a court of competent jurisdiction, the remaining provisions shall nevertheless continue in full force and effect without being impaired or invalidated in any way. The invalid, void, or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, shall be severed from this agreement, and all other provisions shall remain in full force and effect.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law provisions. The parties consent to the exclusive jurisdiction and venue of the courts located in Illinois for any legal proceedings arising out of or relating to this Agreement.
